Rick Hill, Montana's former US Representative from 1997-2000 is running for Governor.

I was reading the Electric City Web Blog and noticed that someone else, namely Gregg Smith had the same impression that I did. Rick Hill GETS IT.

That is, Rick Hill gets the real problems Montana faces, and where those problems lie. Rick's competitor for the Democrats is Steve Bullock. Steve Bullock creates the problems, and exploits the problems in Montana:

As soon as a candidate for Governor indicates lucidly the issues that need to be faced like this, instead of grandstanding in the "owned press" like Lee Enterprises in Montana (www.leeenterprisessucks.com), in the Montana Supreme Court, or in the US Supreme Court, and wallop the Montana citizens with their own Medical Marijuana law, a guy like Rick Hill needs to be flat out ELECTED in Montana.

Rick Hill already represented us as our elected US Representative. He has had reflection time, and is geared up to bring Montana where it needs to be--into prosperity.

Notice how Rick Hill's message is simple and effective: Move Montana forward. There is no doubt that Rick Hill can be effective in doing a very important but critical work Steve Bullock will not do.

Steve Bullock's campaign ads only talk of "accomplishments" and not the vision that is required in political leadership. Rick Hill has that vision as described in the quote above, and can do it clearly and effectively. Montana needs this type of leader, not a bully and a bender of rules, laws, justice, and others. There is no comparison between Steve Bullock and Rick Hill.

One is a leader, and one abuses his power. We have too many problems in Montana to elect a Governor who will only create more problems and give favors to party line officials and friends.

Rick Hill will sweep the Montana Governor race in 2012 due to his leadership, and vision. Independents, Republicans, and conservative Democrats will ensure a victory for Rick Hill.

Make sure to register, speak to your family and friends, and VOTE November 6, 2012 for Rick Hill.

Rick Hill Jon Sonju 2012

Rick Hill is running for Governor of the State of Montana. He choose Jon Sonju as his running mate. Here is a picture of them while campaigning. Note that Sonju is a state senator, and a 36 year old business man from the Flathead (Kalispell area) of Montana.

While the Champagne bottles may be a bit early, it is nice to see that a Baby Boomer like Rick Hill can see talent in the Generation X crowd in Jon Sonju from Kalispell.

I doubt that Rick Hill has threatened anyone's livelihood like Steve Bullock did to protect a party line official in Montana. Steve wont get away with that one as it will affect his election for Governor.

I would also imagine that Rick Hill and Jon Sonju have not protected the unethical and criminal act of any Montana Professional like Steve Bullock has in Montana: Angela Wetzsteon's unauthorized practice was protected by Steve Bullock's Tort Defense under Michael King.

Some of you may be wondering who this Montana Cowgirl is. She seems to be writing about and against both major Governor Candidates in Montana. The problem is that she has those horse blinders on for the Democrats, without taking in the whole picture.

The Montana Political News writers are dedicated to telling the truth, and coming from an INDEPENDENT standpoint. Unlike the Cowgirl Blog, who feel Democrats cannot do any wrong, we think its wrong and dangerous to mislead people on the Internet.

Lets let the candidates for Montana Governor present their own credentials on the campaign trail without any bias from any source. It is true that Steve Bullock abuses his power, and bends the rules. I am sure a US Representative like Rick Hill has regrets, but not nearly as many as Steve Bullock.

Lee Enterprises is hanging precariously 13 cents above NYSE doom as their stock price is only 1.13 as a 1.00 minimum is needed. Funny that executives of Lee Enterprises were rewarded for their successful run through US Bankruptcy Court. Perhaps the reward was too soon as Lee Enterprises in Montana engages in crime cover up, and determines that public officials can be protected when engaged in criminal acts. Our First Contact was a Phone Call from Detective Jamie Merifield, she had heard of my death threat case and called me to help. Then there were these emails, then NOTHING. And for 3 more years Sean Boushie has attacked me, incited hate, emailed threats, commented hate on all my Video Channels, subscribed to all I do online, started hate groups, ruined my real estate business, ran hate ads on craigslist, started a facebook hate group, emailed anyone I ever wrote on to get them to hate me, he threatened me, defamed me, and put me under extreme duress for years AFTER Detective Jamie Merifield, Missoula Montana Police Department asked the man I claimed threatened to kill me if he did it, he said no and the investigation was over.

The Lincoln County Police took a complaint regarding the Email account CrystalCoxIsABitch@Yahoo.com, the email account that threatened me, this proof is held by Bernie Cassidy, Lincoln County Attorney to protect and cover up crimes.

I told this all to Judge Robin Clute in Hamilton Montana with Proof and she gave my Stalker a protective order against me, and not a mutual order. This was 3 years ago now and my stress, duress, life has changed forever. I have lost everything I ever knew to be my life. One of Steve Bullock's downfall as he attempts to run for Governor of Montana is his strong favor for Obamacare. Come June of 2012, Steve Bullock will wish he was with the winning team: the group of US State Attorney General who filed suit against Obamacare.

One of the biggest rats to Montana has been Steve Bullock. Anything the party wanted: be it marijuana raids, or party line Attorney General protecting a failed, unconstitutional policy that was the detriment of the American and Montana people.

Once June rolls aroung and the US Supreme Court does a partial or full remand of Obamacare, politicians like Steve Bullock will have nothing to show for his partisan loyalty, other than electoral defeat by the Montana voters in November 2012.

Steve Bullock has been so arrogant about his assumed power at the Montana Attorney General--not helping Montana citizens, maintaining one of the worst judicial systems--the State of Montana, and even covering up crime he is sworn to protect.

As the Democrats are jumping ship from Obamacare after June 2012, the loyal like Steve Bullock in Montana will have nothing to show for their efforts other than entering private practice.

Steve Bullock is running for Governor of the State of Montana. He did not declare an office, as all other candidates do, and raised over $100,000 without telling people what he was doing. Most people call that fraud. Steve Bullock calls that fair game.

In violation of Montana Ethics Rule 5.5, Steve Bullock protected the triple felony of a law student named Angela Wetzsteon. Angela entered tampered evidence after discovery violating court rules, and now works as a state prosecutor for Ravalli County (which does not lawfully exist via Montana Code Ann. MCA 7-2-2103). Angela Wetzsteon's Law Dean in Montana, Edwin Eck got a US Presidential Appointment to look the other way for Angela Wetzsteon's crimes.

On January 15, 2009 by official manifest of the Ravalli County DAV, I was driving a DAV van with 8 veterans. The roads were snow packed and icy as we made the three plus hour drive from Hamilton, MT. The roads were so bad in fact that the Fort Harrison VA hospital staff made bets whether the Bitterroot Van (driven by me) would even make it over the pass to Helena where the VA Hospital is located.

On the return trip home, a nugget of an individual named Eric Wells was added onto the itinery for the trip. This Wells person could not stop talking about Jon Tester. He was buddies with him, he was in his inner circle, he was a trusted go-to man, and much more bullshit than that. Well, Eric Wells was rambling on about Jon Tester, one of our US Senate representatives from Montana.

This did not go over well in the DAV van, and mind you I was navigating a icy mountainous pass highway with 8 veterans and myself on roads that most did not think we would make it over that day. There is no doubt that this Eric Wells was a present from Jon Tester's people. This gem was the reason I no longer drive veterans to Fort Harrison in Montana.

As we make our scheduled stop at Drummond, MT for gas, coffee and rest rooms, we are approached by Ravalli Co. road workers who mockingly say how "thankful" they are for the service from the Veterans. All of the veterans will stay nameless other than Mr. Eric Wells to protect their privacy. I believe Mr. Jon Tester, through Eric Wells staged the harassment of myself, and 8 veterans; putting our lives at risk on dangerous roads as Jon Tester's plant harassed the driver.

So the next time Jon Tester tells you he is supportive of Montana Veterans, tell him he is full of crap. It is not a new idea among the veterans, and is well known that Jon Testers grip on public service is to the pretext of helping veterans. As January 15, 2009 clearly demonstrates, Jon Tester uses whomever he wants, puts in danger Montana Veterans to show off his power as an old boy, dumb boy willing to endanger his own constituents, and Montana Veterans.

Let Jon Tester lose his Senate Seat in Montana. If he has to act like a school boy and bully the veterans he says he protects, call him for what he is:

Paige Trautwein for 21st District Court Clerk

Paige Allen Trautwein is running for District Court Clerk in Ravalli Co. Montana. Out of all the staff in that office currently under Debbie Harmon, Paige is by far the most professional.

The clerks are verbally abusive, call in threats as regular business is attempted to be carried out in Hamilton MT. Paige Trautwein did not participate in this problem, nor would she tolerate such misconduct on her staff as Clerk of Court.

Believe it or not, the 21st District Court does not have a notary service. The Ravalli County Comission was informed, and asked how a court can function without a notary. They cannot afford it was the answer. It is hoped that Paige Troutwein if successful in becoming clerk of court in Ravalli Co. will introduce notary service for court documents, and court business. It is impossible to have a court, or clerk of court without a notary.

Paige Troutwein executed an affidavit for one of the last official sworn documents to be passed across the couunter at the District Court clerk office. It said that no crime was committed prior to sentencing for speaking in public, a felony crime:

Out of the 6 lawsuits I was forced to file in attempt to recover injury, I dealt with Paige Trautwein the most. She had professional service as a deputy clerk at the 21st Judicial District. As the video showed from above, she was never verbally abusive, and always had prompt service, even to a non-attorney with business before the Ravalli County Clerk of Court.

Marc Randazza offered to buy Marc Randazza.com long ago, though Kashmir Hill of Forbes has the story all wrong, and has not even seen the entire email communication between Blogger Crystal Cox and Marc Randazza nor does she know of the content of the Marc Randazza Crystal Cox phone call.

Anyway, Marc Randazza offered for the Domain Name, then he demanded, both I refused. Then Marc Randazza, to teach me a lesson, called the Plaintiff in Obsidian V. Cox to offer Testimony, a Deposition, to set me up for Extortion though I never Extorted Him. This because he was upset over me buying the Domain Name, which is certainly NOT illegal.

AFTER Marc Randazza Joined Forces with the "Bad Guys", the Plaintiff, and I, being my own attorney was given notice of Marc Randazza's Deposition to set me up, then I got upset and AFTER this, I bought several more dotcoms to prove a point, and noticing that Marc Randazza 's wife and daughter's dotcom was available, what better way to make the point of how bad he is at this "Domainer" thing, and how he is NOT the Internet Expert he Claims to Be.

See even after Marc Randazza threatened me for own his dot com and even though he defened Isaac Eiland-Hall in the buying, owning and using the domain name

Marc Randazza emailed me and told me I have no right to own a domain name that resembles his name. Talk about Double Standards. Was it extortion for the Glen Beck name to be purchased and used attacking Glen Back and accusing him of rape and murder? This Domain Name "implies"that a Young Girl is a "Minor" right? And it accuses a man of a Rape and Murder. This is Ok in the Eyes of Attorney Marc Randazza, but for some reason me Owning MarcRandazza.com is not, nor Owning JenniferRandazza.com and his childs name, which I bought AFTER he joined the plaintiff to PROVE and to prove Point, and I never Published that Information he did that. Popehat.com Kenneth White and Marc Randazza did that with her photo, as did Forbes Kashmir Hill. NOT ME.

Even after the threat to me for buying MarcRandazza.com, he still was to dumb to buy the dotcom of his own wife and child. I wanted to point out that he was a Fraud in his representation to Potential Clients, as I had interviewed Marc Randazza to possibly represent me, and he was so Disrespectful that I chose a better choice for me and for the Entire Blogger V. Journalist, Free Speech, First Amendment Rights Debate. I did not initiate connect with Marc Randazza, nor Him to me, we agreed to talk through the recommendation of another person, one of my Investigative Bloggers, whom was also on the call.

I never "Begged" Marc Randazza to be my Attorney, in FACT I never even asked. I simply took the call in order to feel out my options, and get more information on what I thought to be Experts in the First Amendment Bar. I had already been contacted by the Attorney I did choose and was weighing my options. And trying to learn all I could for best of for all who do what I do, so I could make the right decision on the next step for the Greater Good.

Those believing I begged him to be my Attorney are Flat Wrong, think about it, why would I do that when I already had what I deem to be the most respected First Amendment Expert. A Legal Scholar who treated me with respect and focused on the Merits of the Case and nothing petty what so ever. I chose a man who is Respectful of my Rights and Talks kind to me, treats me with dignity even if he disagrees he is respectful about it and presents a very Intelligent, Sensible reason why he may disagree.

And yes I took a call to see what Marc Randazza Had to say, to offer, and out of respect for my Investigative Blogger whom contacted him. And I took the call to explore my options, thing is we did not speak again and next thing I knew, he was telling others he represented me and I had already agreed to work with the Attorney I chose. I had to contact Marc Randazza to tell him he did not represent me and why, I will be posting that email in Full coming soon. No one sentence pulled out as Kash-Shmear Hill likes to do, instead of investigate the entire TRUTH and Real FACTS.

Keep in mind this Plaintiff that Marc Randazza decided to align with was the same Plaintiff he was negotiating with in December of 2011, on my behalf and WITHOUT MY PERMISSION. Now Cut to David Aman, the Original Accuser of Extortion, and the One whom gave Forbes the infamous, false light defamatory email AFTER he had already won his case against me. Last summer (2011) an article was written on how Montana Governor Brian Schweitzer would be a great candidate for President in 2016. The argument stated how speakers at the DNC ( Schweitzer spoke in Denver 2008) usually show up on the Democratic ticket.

The problem with the projection of Montana Governor Brian Schweitzer to the presidential race in 2016 is the ranking in the USA with Montana LAST. The US Justice Department ranked Montana 48 of 48 states for Justice in 2007 as Brian Schweitzer was completing his first year.

As law enforcement is out of control, are getting sued for civil rights, and the FBI are promoted for misconduct, and lack of ability to follow its national priorities, you have the quagmire condoned by Brian Schweitzer in Montana. Complete counties are not lawfully in existence, and even with a major victory for his Democratic party, Brian Scweitzer completely wants to sit back in pre-retirement as a Governor.

Brian Schweitzer is all talk and no action.

Montana is ranked last for justice.

See, after my 2.5 Million Dollar Set Up to “Attempt” to Hide the Secrets of Obsidian Finance Group, Tonkon Torp and other Big Oregon Law Firms and Corporations, well, one of my Bloggers contacted Marc Randazza and I agreed to a 3 way conversation to interview Marc Randazza, and he had agreed with my Blogger to talk with me in the possibility of taking my case.

During this call Marc Randazza said that if he took the case he would need money for a certain amount of costs and that it would be an expensive case to file appeal. He said, in a case like this he would normally charge at least $75,000. However, he was considering Pro Bono due to the Media attention I was getting, but even in that would need cost for copies and to be in a hotel in California for the appeal, if he or someone he recommended were to take the case.

Marc Randazza gave many signs during this call that Marc Randazza would most likely not represent me.

During this call Marc Randazza said he was concerned of the “record” and had to take a look at it before deciding. I said that was a responsible thing to do, he said he would look at my documents and get back to me, he did not get back to me, yet told others he represented me, more on that in a bit.

Marc Randazza told me on this call that I had “made a mess,” which I found very slamming as what I do is for the Greater Good and what I was exposing was and is on the right side of the law and certainly on the right side of the Moral Compass.

Marc Randazza saying this, let me know that he had no idea that what I did was a ‘calling,’ it was for massive change and a good thing to bring attention to this issue. Marc Randazza treated me as if I had made a “mess” and with complete disrespect. When in fact, I am creating “Media” and “Legal” attention to something that is VERY important for the Greater Good of ALL.

Marc Randazza said that he was concerned with my “Journalistic Standards”, SHOCKING isn't it, a Porn King Attorney representing folks that "Society" judges and Marc Randazza is judging and slamming my “Journalistic Standards”? Anyway this disrespectful comment led me to believe that Marc Randazza seemed to have been eating up the bad information about me, this was another sign to me that Marc Randazza was not going to represent me.

I am an Investigative Blogger. And a Very Good ONE. For Over 3 years, I have read contracts, insider emails, legal briefs, documents, LLC Agreements, Legal Filings and I listened to Audio’s of Court Sessions, watched videos of depositions and insider meetings and I interviewed, and yes took notes from the side of the Debtors, Investors, Creditors and more in the Summit Bankruptcy, deeper than any other news outlet. I have covered this story in depth and linked to lots of proof and documentation.

The Media Bloggers Association should pay close attention, as what I was doing was exposing documents, and linking to those documents, and this is what most all bloggers do. The fact that I curse, Capitalize in Odd Places and have my own "Independent Style", well that make me legally "media" as well, and it does not change the Facts. I do what ALL good Investigative Bloggers, Alternative News and Citizen Journalists Do.

Big Media wants to shut me up, so they lie about me, and for some reason Marc Randazza ate up what Big Media said about me, even though it was NOT True. Marc Randazza did not care about my side. Marc Randazza simply ran me over with his personal opinions and agenda.

Marc Randazza told me that he used to work for Big Media but now he works for bloggers and porn stars, because Marc Randazza claimed that Big Media had the agenda of creating a Monopoly so they make more money. Yet NOW Marc Randazza is working with the Plaintiff in Obsidian V. Cox.

Marc Randazza told me that he would have to talk to his existing clients, such as The Media Association of Bloggers, to see if there was a conflict before deciding to represent me or not. Marc Randazza claimed he would get back to me on this. Instead, Marc Randazza contacted the Plaintiff’s side and tried to cut a deal WITHOUT my Consent, without “getting back to me” and without discussing if he represented me, wanted to represent me or if there was a Conflict.

Meanwhile Marc Randazza, of The Media Bloggers Association (MBA) , told lots of people in the “business” that he represented Blogger Crystal Cox, yet that was NOT True. I had agreed to work with another Lawyer and this created a situation that caused me stress, and almost lost me the Lawyer I really wanted.

Did Marc Randazza have to “discuss” a conflict with the Media Bloggers Association (MBA) in any way BEFORE Marc Randazza called the Plaintiff’s side and tried to work out a deal, as if he represented me? I was told at that time by other members of the First Amendment Bar that Marc Randazza was talking with the Plaintiff’s side and trying to work out some arrangement regarding money, or a change to case law. I was Pro Se for a year and I wrote over 50 Court Filed Documents myself. I was and AM in the KNOW on my Case and Marc Randazza simply left me out, as if I had no brain, no rights and with total disrespect for me, Blogger Crystal Cox.

Marc Randazza simply and certainly unethically took it upon himself to contact the Plaintiff’s side of Obsidian V. Cox, without my knowledge and without getting back to me on if he wanted to work with me or not, Marc Randazza simply left me hanging with time running out and was working behind my back on a deal. Is this Legal? Well it is certainly NOT Ethical and certainly shows no respect for bloggers nor the First Amendment Rights that Marc Randazza, Allegedly wants to protect.

Also on that first phone call Marc Randazza said he thought it was funny that the Plaintiff thinks they can get $2.5 Million out of me, and now Marc Randazza has offered himself up to help them get any assets they think I have and ESPECIALLY that $10 Domain Name, Marc Randazza .com, that dumb shit Marc Randazza NEVER Registered for himself. Marc Randazza is helping the Plaintiff to take Domain Names, which is my only way to make a living, and all in the name of “Constitutional Rights” What? This makes no sense and is NOT True.

Marc Randazza is Vindictive, plain and simply. He was not chosen in the BIGGEST case that the blogsphere has EVER seen regarding one blogger, and a case that will change laws and is already a world wide phenomena and that blogger, me, had the nerve to buy Marc Randazza .com and to even suggest that Marc Randazza hire her to do PR for him. Marc Randazza is so mad that Marc Randazza is making ALL Bloggers the Collateral Damage of Marc Randazza’s EGO.

In one of Marc Randazza’s last communications to me he said “do you really want to make an enemy of me?” Marc Randazza thinks that a blogger, a woman being smarter than him is making him an enemy.

So Marc Randazza is on a mission to teach Blogger Crystal Cox a lesson and be “Deposed” to rant about me to the Plaintiff to attempt to further quash my “Free Speech” and First Amendment Rights, and thereby affecting all BLOGGERS and Alternative Media Worldwide.

Marc Randazza told me that if I appeal it MAY create Bad Law and that maybe I should consider NOT appealing so that my case can be used to Lobby for others in changing laws. I was in agreement, and told Marc Randazza that I simply wanted advice from those surrounding the First Amendment Rights Issue and the First Amendment Bar, so that I could do what was best for all Bloggers, Citizens Journalists and the First Amendment Rights of All. Marc Randazza said he was very glad to hear that, and it made him want to work with me even more.

Marc Randazza said, if I take your case then my Ethical Duty is to you, yet Marc Randazza acted as if he had taken my case, without talking to me about it, and was already negotiating with the Plaintiff’s side of Obsidian Finance Group Vs. Blogger Crystal Cox.

To me, Crystal Cox, this says that Marc Randazza was already acting as my attorney, and did have an Ethical Duty to me to not disclose my stance, emails, or private conversations with him. Yet Marc Randazza contacted the “Other” side to Negotiate, and that was in December. Now Marc Randazza is using information I gave him in a Deposition that Marc Randazza is giving the "Plaintiff" to attempt to put me in my place and to take a $10 Domain Name that Marc Randazza was not smart enough to buy, and this, in my opinion, is an Ethical Breach, if not Plain Ol’ Illegal.

Last December I found out that Marc Randazza was Negotiating with the Plaintiff’s Side OF MY LEGAL CASE without my PERMISSION. I was told this by other members of the First Amendment Bar that wanted to represent me. They had heard that Marc Randazza represented me and even spoke with Marc Randazza, and he had flat out claimed to be representing me, yet Marc Randazza had not told me he was even still considering representing me, Blogger Crystal Cox. I was told by other Attorneys that I needed to let Marc Randazza know that he did not represent me, because Marc Randazza was telling everybody that he did represent Blogger Crystal Cox on Appeal of Obsidian V. Cox (I have Emails and more to Prove this).

Marc Randazza has so little respect for potential clients that Marc Randazza simply does as

Marc Randazza pleases without his client’s or potential client’s knowledge.

Can I Sue Marc Randazza for trying to make a deal, acting as if he was my attorney without my consent? I certainly can file Bar Complaints in NV, CA, MA, FL, and AZ to Start.

Marc Randazza is now part of a Witch Hunt to discredit blogger Crystal Cox, in effort to protect Big Corporations such as Obsidian Finance Group, Pacific Power, Government Oversight people such as Judge Randall Dunn and Pamela Griffith of the Department of Justice and Law Firms such as Tonkon Torp, Sussman Shank and Perkins Coie.

Marc Randazza is sacrificing the Free Speech rights of ALL in Marc Randazza’s own personal Ego trip over a blogger that bought Marc Randazza .com. Marc Randazza is NOT a man for the rights of Free Speech. Marc Randazza is a man for the personal EGO Trip of Marc Randazza.

So how is Marc Randazza working with the “Bad Guys” and on the Opposite Side of Free Speech?

Marc Randazza is helping the Plaintiff to set me up. Marc Randazza is pretending to be under subpoena and pretending to have no choice, but the truth is that Marc Randazza called the Plaintiff, and Marc Randazza initiated dealing with them against me because his EGO is bent that I did not CHOOSE him and I bought Marc Randazza .com. Marc Randazza is even flying to Portland to be deposed at the Tonkon Torp Law Firm. Gee I wonder whose dime this is on? And all this because they want to Silence a Blogger Exposing Corruption and to spite a Pro Se Defendant who went with a different lawyer and bought the whiny baby’s name as a dotcom.

According to wikipedia.org, Marc Randazza’s first case was representing a fraternity at Boston University, when the brothers of that fraternity were accused of destroying a house they had rented and accused of other misconduct. Marc Randazza seems to have started right out working for the wrong side of the law and certainly the wrong side of the law in representing drunken fraternity brother’s who seem to have destroyed some one’s property.

Marc Randazza is a Public Figure, indeed having been in debates on Fox news and other television and having worked for Big Media as Marc Randazza told me. So why are there not more bloggers EXPOSING Marc Randazza ? Well I guess, Marc Randazza really was for blogger’s rights, until he got all BENT over Blogger Crystal Cox and decided to be part of taking down the Free Speech Rights for ALL Bloggers.

Yes, I am under the impression that back in December, Marc Randazza contacted the Plaintiff to make a deal on my behalf for them to change the judgement so it would not affect the Porn Industry Free Speech, and this was to be in my best interest. And I was told that at that same time Marc Randazza claimed to many in the First Amendment Bar, that he represented me, and yet Marc Randazza had not told me, the “Alleged” Client. In my Opinion, based on my personal experience I do not recommend nor trust Marc Randazza.

Marc Randazza, seems to me to work on the OPPOSITE side of Free Speech in order to teach a female investigative blogger a lesson for being smarter than him.

Marc Randazza was not offered the chance to buy Marc Randazza .com, NO WAY. Philip Falcone seems to be Fighting Back. Seems to me that Senator Grassley flat out lied about the events and issues surrounding Lightsquared. "For the last decade, LightSquared has planned to deploy a terrestrial network, and worked with the GPS community to make sure its network would not interfere with GPS.

LIGHTSQUARED’S SERVICE HAS BEEN EXPECTED FOR ALMOST TEN YEARS

· In 2001, LightSquared proposed using satellite spectrum for a fully-capable ground network. In 2002, after discussions with the GPS industry representatives, LightSquared agreed to curtail any portion of its signal that crossed into GPS frequencies. This agreement imposed restrictions that were 1000 times stricter than what the FCC rules eventually required.

· In 2003, the FCC adopted initial rules allowing LightSquared’s ground network to operate near GPS. These rules were adopted after a full review by DoD, FAA and all other interested government agencies. As the FCC said recently, “extensive terrestrial operations have been anticipated in [LightSquared’s spectrum band] for at least 8 years.” FCC MSS Flexibility Order, ¶ 27 (Apr. 6, 2011).

THE GPS INDUSTRY UNDERSTOOD THE SCOPE OF LIGHTSQUARED’S NETWORK

· The 2003 rules allowed LightSquared to deploy over 10,000 base stations.

· In 2003, the U.S. GPS Industry Council (“USGIC”) stated that the restrictions of the 2002 agreement were necessary to protect GPS against “[t]he increased user density from potentially millions of MSS mobile terminals operating in ATC mode . . . [and] potentially tens of thousands of ATC wireless base stations.” Reply Comments of USGIC, IB Docket No. 01-185, at 2 (Sept. 4, 2003) (emphasis added).

· In 2004, the USGIC supported the LightSquared application for authority to operate a ground network under the 2003 rules, stating that the 2002 agreement was “intended to protect GPS receivers and at the same time allow [LightSquared] to maximize the utility of its ATC [ground network] service to its users.” Letter from USGIC to FCC (Mar. 24, 2004).

· In 2005, the FCC removed all limits on the number of base stations LightSquared could build and increased their permissible power to 1.6 kw, the level at which LightSquared now plans to operate. Again, this decision was reviewed by all interested government agencies and was not challenged by USGIC.

· Beginning in 2006 and continuing to 2010, LightSquared disclosed its intent to build a wireless network using tens of thousands of base stations in its annual filings with the SEC.

THE GPS INDUSTRY KNEW ABOUT LIGHTSQUARED’S PLANNED POWER LEVELS AND DID NOT OBJECT

· In 2009, LightSquared asked the FCC to increase the power levels of its base stations by approximately 10 times to 15 kw, to match the power levels at which other wireless networks are permitted to operate.

· USGIC did not object to even those higher power levels. It objected only to the possibility of interference into the GPS band from low-power indoor femtocells, an objection it withdrew in August 2009 after reaching agreement with LightSquared.

· In March 2010, the FCC approved LightSquared’s increased power levels. As with all previous FCC proceedings, the order was issued after a public proceeding and was fully coordinated with all interested federal government agencies. Neither GPSIC, nor any other party, filed for reconsideration or review of this order.

· Also in March 2010, the FCC required LightSquared to build a ground network reaching 260 million people by the end of 2015. Neither GPSIC, nor any other party, filed for reconsideration or review of this requirement.

LIGHTSQUARED IS DOING EVERYTHING IT CAN TO WORK WITH GPS TO ADDRESS ISSUES RAISED ONLY A FEW MONTHS AGO

· In September 2010, USGIC raised for the first time — in a general mobile satellite proceeding -- the possibility that some GPS receivers may be subject to interference because they can be overpowered by signals transmitted by LightSquared inside the spectrum the FCC licensed to Lightsquared.

· In November 2010, LightSquared applied to allow devices onto its ground network that do not also communicate with its satellite. This application did not change the power, number, deployment or any other technical characteristic of LightSquared’s base stations. USGIC raised the same objection it raised in September.

· Although the interference issue was irrelevant to this application, LightSquared, in January 2010, proposed a rigorous program of testing to determine the extent of the susceptibility of GPS receivers to LightSquared’s transmissions, which the FCC made a condition of granting LightSquared’s application on Jan. 26, 2011.

· The FCC validated the GPS testing process a few weeks ago by unanimous Commission vote, noting USGIC’s September 2010 comments and the cooperative testing program, and stating that “responsibility for protecting services rests not only on new entrants but also on incumbent users themselves, who must use receivers that reasonably discriminate against reception of signals outside their allocated spectrum.” FCC MSS Flexibility Order, ¶ 27 (Apr. 6, 2011).

The government's own studies show however, that most abuse reports are "unsubstantiated", and children are removed from their parents based on those "unsubstantiated" reports to the destruction of children and to the detriment of American familes.
